Slip-and-fall accidents can happen almost anywhere, from a grocery store to a public sidewalk or even in government buildings. If you suffer injuries in these accidents, you may try to recover damages from the property owner.

However, Maryland follows a strict legal rule called contributory negligence, and it plays a major role in how these cases turn out.

What is contributory negligence?

Contributory negligence means that if the injured person shares any fault for the accident, they cannot receive compensation. Even one percent of blame can block a full recovery of damages. Maryland is one of only a few states that still use this strict approach.

How does contributory negligence come into effect?

In a slip-and-fall case, the property owner may argue that the injured person acted carelessly. For example, they might say the person ignored a warning sign or walked while distracted by a smartphone or other device. If the evidence shows the injured person failed to act with reasonable care, the court may rule against them. That means no compensation for medical bills, lost income or pain and suffering.

How can you prove that you did not contribute to a slip-and-fall accident?

Property owners must maintain a safe environment, fix known hazards and warn visitors of any dangers. Your slip-and-fall claim will likely involve detailed evidence such as photos, witness statements or surveillance footage. These materials can help show that the property owner knew about the danger and that you took reasonable steps to avoid it.

Understanding how contributory negligence works can help you make informed decisions when pursuing compensation. Maryland’s strict rules can make slip-and-fall cases more difficult to win, but taking quick and decisive action can ensure that you protect your ability to make a successful claim.

Slip-and-fall accidents can happen to anyone. These incidents can lead to severe injuries that need to be addressed. Aside from understanding the impact of such cases in your day-to-day life, it’s also crucial to know the legal timeframe for filing a lawsuit.

What is a statute of limitations?

A statute of limitations is a law that provides the maximum time for a legal proceeding to be initiated after an event. The statute of limitations varies depending on the felony and the state where the crime was committed.

Why does a statute of limitations exist?

The statute of limitations serves several purposes. First, it ensures prompt response to cases, while evidence remains fresh and witnesses still have clear memories of the event.

At the same time, it also allows offenders peace of mind from suit after a reasonable amount of time has passed. This sense of security and closure is necessary so they won’t face indefinite legal uncertainty.

When does the clock start ticking?

In most cases, the statute of limitations for a slip-and-fall case begins on the accident date. However, there are exceptions to this rule. For instance, if the injury wasn’t immediately apparent, the clock might start when the injury was discovered or should have been discovered.

The statute of limitations period for slip-and-fall cases varies by state. However, it typically lasts from one to six years. In other words, if you don’t file your lawsuit within that specific time, may not be able to seek compensation for your injuries.

Understanding the statute of limitations for slip-and-fall cases is vital for protecting your legal rights. If you’ve been injured in a slip-and-fall accident, don’t wait too long to take action to receive the compensation you deserve.

IS YOUR CAR A TICKET MAGNET?

According to Insurance.com, the car insurance comparison-shopping website, in the analysis of insurance claim and traffic violation data from 331 car models and more than 323,00 customers, the following is a list of vehicles that were ticketed most often, and also filed an above average count of insurance claims. Last year’s car with the most tickets was the Subaru WRX. It was driving by mostly 20 year old men, it fell to number 12 on this year’s list.

A survey of which car makes and models received the highest and lowest number of traffic tickets over the past two years found those behind the wheels of the Lexus ES 300, Nissan 350Z and Dodge Charger SE/SXT were ticketed most often, and also filing an above-average count of insurance claims. From the list you can see that luxury cars received the lowest number of traffic tickets over the past two years.

“It’s the driver that gets tickets, not the car,” Penny Gusner, consumer analyst for Insurance.com, said in a statement. “But it is interesting to see what vehicle makes and models attract drivers who are prone to traffic violations.”
