What Happens When an Excluded Driver Is in an Automobile Accident?

The excluded driver will not be covered by the insurance policy of the vehicle they were driving. The excluded driver will not be eligible for personal injury protection (PIP) or medical payment (medpay) coverages and uninsured motorist bodily injury coverages. Passengers involved in an excluded driver’s vehicle are eligible for PIP coverages on the insurance policy. When the excluded driver is in an accident, the vehicle will not have collision coverages. If the accident is not covered, then the driver’s personal assets could be at risk for property damages and bodily injuries caused in the collision and may be sued personally.
