What Should My Plan of Action Be Following a Washington, D. C., Motorcycle Accident?

Though no one ever wants to be in the situation where they need to know what to do following an accident, if the time ever comes where you need to act, it is absolutely critical that you do the right things at the right time.

Not only will taking the proper actions help ensure that you are able to recover the highest possible damages, but you will also be able to ensure that you get the proper medical attention and legal help should the need arise.

Just as in any vehicle crash, the first thing to do is make the scene of the crash as safe as possible for you, the other driver, responding personnel, and witnesses. In a minor accident, this generally means moving as far off the main road as possible and making the vehicles as visible as possible. In a very serious accident, however, this may not be possible. In this situation, seek medical attention immediately for any injured parties, and call local or state law enforcement to the scene.

Other than the priority items — seeking medical help and securing the scene — there are four things you must do following your D.C., Virginia or Maryland motorcycle crash.

  • Record what happened: The sooner you are able to record, either in writing or via an audio recording, the better. Though you need to give yourself some time to let the adrenaline and emotions from the accident subside, once your mind is clear, make a detailed account of what happened — the moments leading up to the accident, road conditions, etc.
  • Exchange contact information: Not only will you need contact and insurance information for the other driver, but you will also need the info of any witnesses and the responding law enforcement officials. Should your case go to trial, you will need to be able to contact these individuals.
  • Pictures, pictures, pictures: Take pictures of everything — your motorcycle, the crash scene and other involved vehicles. Also document any injuries you suffered at the scene, as well as your recovery process.
  • Make it official: Be sure that the responding officer files an official and accurate police report.

If you have been hurt in a motorcycle accident, the time to act is now. The longer you wait to seek legal advice, the more mistakes may be poking holes in your formerly airtight case.
